Alwyn is a key member of the financial services practice. He has extensive experience in establishing and advising clients on seeking authorisation by the Securities and Futures Commission (SFC) of unit trusts and mutual funds domiciled in Hong Kong and overseas jurisdictions including RMB denominated funds, QFII and RQFII funds, and UCITS funds. He also advises on on-going compliance and post-authorisation issues.
In addition, Alwyn advises on the structuring and establishment of private investment funds. He regularly advises on regulatory matters across a broad spread of issues affecting the asset management industry in Hong Kong. He helps clients to set up their Hong Kong offices and obtain appropriate SFC licences.
Alwyn is experienced in advising on Hong Kong profits tax and stamp duty issues.
Most recently, Alwyn leads the team which advised over 90% of the first two batches of South-bound funds in successfully obtaining SFC’s approval on their applications under the mutual recognition of funds scheme since its launch.
Other highlights include assisting a leading global investment firm in obtaining SFC authorisation of index funds tracking the reference portfolios of the MPFA’s DIS regime. It is one of the first ITCIS tracking the reference portfolios of the MPFA’s DIS regime, which would serve as the building blocks for the DIS core funds of MPF schemes.
Alwyn also has extensive experience in Hong Kong with retail funds including UCITS funds and Hong Kong domiciled funds. He is one of the leading Chinese speaking partners on RQFII matters. Deacons advised 14 of the first batch of 21 RQFII funds brought to the market in 2011/2012, and the team continues to advise on RQFII funds and mandates.
Alwyn regularly participates as a speaker in industry seminars in Hong Kong and overseas, covering topics including mutual fund recognition between Hong Kong and China, RMB products in Hong Kong and SFC authorised funds.
